Delivery Partner Terms & Conditions

These Delivery Partner Terms & Conditions ("Terms") govern the relationship between GaliKart ("Platform", "Company", "We") and the individual or entity registering as a Delivery Partner ("You", "Rider", "Partner").

By onboarding or accepting delivery tasks on GaliKart, you agree to these Terms.

1. Nature of Engagement

  • Delivery Partners are independent contractors, not employees, agents, or representatives of GaliKart.
  • This engagement does not create an employer–employee, partnership, or agency relationship.
  • Delivery Partners are free to choose when and whether to accept delivery tasks.

2. Eligibility & Onboarding

To become a Delivery Partner, you must:

  • Be at least 18 years of age
  • Provide valid identity and KYC documents (Aadhaar, PAN)
  • Hold a valid Driving License (if using a motor vehicle)
  • Provide valid Vehicle Registration (RC) and insurance (if applicable)
  • Maintain a working smartphone with internet access

GaliKart reserves the right to verify documents and reject or suspend onboarding.

3. Scope of Services

Delivery Partners agree to:

  • Pick up orders from vendors listed on GaliKart
  • Deliver orders safely and promptly to customers
  • Handle goods with care, especially medicines and perishable items
  • Follow delivery instructions shown in the app

4. Service Standards & Conduct

Delivery Partners must:

  • Behave professionally with customers and vendors
  • Avoid harassment, misconduct, or abusive behavior
  • Follow traffic laws and safety guidelines
  • Maintain hygiene and appropriate conduct

Violation may result in suspension or termination.

5. Earnings, Payments & Incentives

  • Earnings are calculated per order, distance, or incentive scheme displayed in the app.
  • Payments will be settled as per the communicated payout cycle.
  • GaliKart may deduct penalties, refunds, or adjustments for service failures or violations.
  • Delivery Partners are responsible for declaring and paying their own taxes.

6. Cancellations & Non-Completion

  • Repeated order cancellations after acceptance may lead to penalties or suspension.
  • Failure to complete accepted deliveries without valid reason may impact account standing.

7. Equipment & Expenses

  • Delivery Partners are responsible for their own vehicle, fuel, mobile device, and maintenance costs.
  • GaliKart does not provide employment benefits, insurance, or vehicle coverage unless explicitly stated.

8. Insurance & Risk

  • Delivery Partners operate at their own risk while performing deliveries.
  • GaliKart is not responsible for accidents, injuries, loss, or damage incurred during deliveries, except as required by law.

9. Data Protection & Confidentiality

  • Delivery Partners may access limited customer data strictly for delivery purposes.
  • Such data must not be misused, stored, or shared.
  • Delivery Partners must comply with applicable data protection laws, including the DPDP Act, 2023.

10. Prohibited Activities

Delivery Partners must not:

  • Tamper with or misuse orders
  • Demand extra payment from customers
  • Consume or damage customer goods
  • Share OTPs, customer details, or order information
  • Engage in fraudulent activity

11. Account Suspension & Termination

GaliKart may suspend or terminate a Delivery Partner account for:

  • Policy violations
  • Fraudulent activity
  • Poor service ratings or repeated complaints
  • Legal or safety concerns

12. Limitation of Liability & Indemnity

  • GaliKart is not liable for losses arising from Delivery Partner actions or negligence.
  • Delivery Partners agree to indemnify GaliKart against claims arising from their conduct.

13. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts in Kanpur shall have exclusive jurisdiction.

14. Modifications

GaliKart may modify these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.
